A recent decision by Dubai’s Conflicts of Jurisdiction Tribunal may significantly affect enforcement strategies involving onshore Dubai assets.
On 6 July 2026, the Tribunal issued its decision in Application No. 004/2026, restricting the DIFC Courts’ ability to use their information-gathering powers in relation to assets located onshore in Dubai. The decision creates an important jurisdictional development for parties enforcing judgments or arbitral awards in Dubai.
It also raises questions about how the ruling will be reconciled with recent DIFC Court of Appeal authority, including Orlagh v Orchid, and the DIFC Courts’ emerging role as a “global enforcement court.”
